Any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, or invalidity thereof shall first be attempted to be resolved through good faith negotiations between the parties. If the dispute cannot be resolved through negotiations within thirty (30) days, either party may initiate binding arbitration in accordance with the Arbitration and Conciliation Act, 1996.
The arbitration shall be conducted by a single arbitrator appointed by mutual agreement of the parties. The seat of arbitration shall be Mumbai, Maharashtra, India. The language of arbitration shall be English. The arbitrator's decision shall be final and binding on both parties.
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's intellectual property rights or confidential information.
We reserve the right to modify these Terms at any time. If we make material changes to these Terms, we will notify you by posting a notice on our website or by sending you an email at the address associated with your account. Your continued use of the Services after such notification constitutes your acceptance of the modified Terms.
